A wife is entitled to maintenance from her husband upon a valid marriage contract, even if she is wealthy or of a different religion, once she submits herself to him even constructively (art. 74). Maintenance covers food, clothing, housing, and related items such as medical treatment and service according to custom (art. 75).
Maintenance is assessed according to the husband's means, whether easy or hard, regardless of the wife's situation, but not below the minimum sufficient for her (art. 76). The wife's maintenance becomes a debt on the husband from the date he refuses to pay while it is due, and is discharged only by payment or release (art. 78). During the case the judge may order temporary maintenance that is immediately enforceable (art. 79).
If a present husband refuses to support her, has no apparent assets, and his insolvency is not proven, the wife may seek divorce, and the judge divorces them at once; he can avoid this by paying the due maintenance (art. 120).
