The bribed official: Any public official who, for himself or another, solicits or accepts money, a benefit, or a mere promise of either, in return for performing an act of his office (even a lawful one) or refraining from an act (even an unlawful one), is punished by imprisonment not exceeding seven years and a fine equal to what was given or promised, even if he intended all along to do the act. A private gain from buying or selling at a price differing from the real value counts as bribery (art. 114).
Briber and intermediary: The same penalties apply to anyone who offers an official money, a benefit, or a promise that the official accepts, and to anyone who acts as intermediary. The briber and the intermediary are exempted from punishment if they inform the public authorities of the crime (art. 115).
Subsequent reward: An official who accepts money or a benefit after performing or refraining from an act, as a reward, is punished by imprisonment not exceeding three years and a fine equal to the money or benefit; the same applies to the giver and the intermediary (art. 118).
