Self-Defense Laws in Kuwait: When Is It Legal?

Lawful self-defence removes criminality when defending person or property against present danger. Killing is permitted only to repel crimes threatening death, sexual assault, or abduction.

Lawful self-defence is a ground that removes criminality: there is no offence where the act is committed in defence of the actor's own person or property, or the person or property of another (art. 32).

Condition: Self-defence only arises where the danger threatening person or property is present and cannot be repelled by timely resort to the protection of the public authorities (art. 33).

Killing in defence: Self-defence permits intentional killing only to repel one of certain specified offences: a crime feared to cause death or grievous wounds where the fear has reasonable grounds; intercourse with a female without consent or forcible indecent assault on a person; or abduction of a person by force or threat (art. 34).

Exceeding limits: Where a person in good faith exceeds the limits of self-defence by using more force than an ordinary person would in the circumstances, without intending harm greater than the defence required, the judge may, if the act is a felony, treat the person as excused and impose a misdemeanour penalty instead of the prescribed one (art. 36).
