When a defect is found, or the product fails to match the prescribed standard specifications or the contracted purpose, the supplier must take the product back with a refund, replace it, or repair it free of charge, within the period set by the trader's announced warranty terms or by commercial custom (art. 14).
This does not apply to perishable consumer goods, goods made to the consumer's own specifications, books, newspapers, magazines, software, and the like (art. 14).
The supplier must also warrant the product or service provided and include this obligation in the sale contract (art. 12). In addition, the supplier must compensate actual damages to you or your property caused by defective or non-conforming goods (art. 20).
If the supplier breaches these obligations (arts. 12 to 19), the penalty is a fine up to twenty thousand dinars and imprisonment up to two years, or one of them (art. 27).
